By booking a session or using this website, you agree to the following terms and conditions.

Booking & Payment

A non-refundable retainer is required to secure your session date. The remaining balance is due prior to or on the day of your session. Session dates are not reserved until the agreement is signed and the retainer is paid.

All sales are final. Digital product pricing includes applicable sales tax. Printed products do not include sales tax, shipping, or handling fees.

Scheduling

Newborn sessions are tentatively scheduled based on your expected due date and finalized after baby’s arrival. Clients must notify the Photographer within 48 hours of birth to confirm scheduling.

Sessions are limited to the agreed-upon number of subjects. Additional individuals may require an additional fee and prior approval.

Animals are not permitted without prior written permission.

 

Rescheduling & Cancellations

Retainers are non-refundable.
If rescheduling is requested at least 14 days prior to the session, the retainer may be applied to a new date within six months, subject to availability.

Cancellations made within 30 days of the scheduled session will result in forfeiture of the retainer.

In cases of illness, unsafe weather conditions, or emergencies, sessions may be rescheduled without penalty.

Location & Travel

Sessions are held at 28612 106th Street, Trevor, WI unless otherwise agreed.
Clients are responsible for location fees, permits, parking, and related costs.

Travel beyond 30 miles from 53179 is billed at $2 per mile each way.

Artistic Rights & Image Delivery

Breann Danielle Photography retains full copyright of all images.

Clients receive a personal-use print release for purchased digital files. Images may not be altered, edited, or sold.

RAW files are not included and may be purchased separately if available.

Proof galleries are delivered within 7 days of the session. Final edited galleries are delivered within 14 days after selections are made. Online galleries remain active for 30 days.
 

Cooperation & Safety

Client cooperation is essential for desired results. The Photographer is not responsible for images not captured due to lack of cooperation, behavior of subjects, or circumstances beyond control.

Newborn safety is prioritized at all times. Composite images may be used for certain poses.

Limitation of Liability

If the Photographer is unable to perform due to illness, emergency, or events beyond control, every effort will be made to reschedule. If rescheduling is not possible, liability is limited to the amount paid.

In no event shall Breann Danielle Photography be liable for damages exceeding the total amount paid under the agreement.

Governing Law

This Agreement is governed by the laws of the State of Wisconsin. Venue for any dispute shall be Kenosha County, Wisconsin.
